DISTRIBUTORS OF NURSERY STOCK MUST BE REGISTERED
Agriculture Commissioner Gus R. Douglass reminds nurserymen, owners
of landscaping businesses, and merchants who sell nursery stock
that they must be registered with the West Virginia Department of
Agriculture (WVDA) before they can legally distribute this type
of plant material. Nursery stock is defined as hardy, woody-stemmed
perennial plants (like trees, shrubs and woody vines) as well as
sod and sod-producing plants. Distributors of bedding plants, indoor
plants, vegetable plants, bulbs, or herbaceous perennials are not
required to register.
Most states regulate the distribution of plant material in order
to minimize the effects of serious plant pests. The West Virginia
Plant Pest Act (Chapter 19, Article 12 of the Code of West Virginia,
as amended) protects our states forests and agricultural interests
from injurious insects and plant diseases by regulating the sale
and movement of nursery stock, while providing for its inspection.
According to the West Virginia Plant Pest Act, it is unlawful for
anyone to sell, offer for sale, or to give away nursery stock without
first obtaining a certificate of registration from the WVDA. The
certificate issued to each business must be conspicuously displayed
at each place where nursery stock is being distributed.
