5.1. The Department adheres to the West Virginia Division
of Personnel's Workplace Security Policy. Each division will maintain
and post a written copy of this policy. Additional written copies
may be obtained from the Personnel Director or on the Internet at:
www.state.wv.us/admin/personnel/Emprel/policies/Worksec2.pdf
5.2. The possession of firearms or dangerous/deadly weapons
on State property by any individual, including any individual who
possesses a license to carry a concealed weapon, is prohibited.
........5.2.a. The only exceptions
to this policy are:
................5.2.a.A.
on-duty federal, state, or local government law enforcement/security
personnel, and
................5.2.a.B.
hunting firearms and equipment such as folding or fix-blade knives
which are secured in a locked personal vehicle on State property.
Firearms used in hunting, must be unloaded, secured and cased while
on State property.
........5.2.b. The possession
of self-defense items such as pepper spray and mace are prohibited
on State facilities, excluding personal vehicles.
........5.2.c. Threatening or
assaultive behavior is prohibited. Any person who exhibits threatening
or assaultive behavior, physical or verbal, or who otherwise willfully
disrupts the orderly and peaceful process of any department, division,
or agency of State government, may be subject to arrest and criminal
prosecution.
........5.2.d. Individuals seeking
entrance to State-owned, leased, or operated facilities may be subject
to security screening procedures which include:
................5.2.d.A.
passing through a metal detector, and
................5.2.d.B.
having personal possessions (e.g., purses, briefcases, backpacks,
etc.) x-rayed or manually searched.
........5.2.e. Penalties for
violating this policy.
................5.2.e.A.
Any person who, upon request, refuses to vacate the premises while
possessing a firearm or other deadly/dangerous weapon may be charged
with a misdemeanor, and upon conviction, may be fined not more than
$1000 or be confined in the county jail for not more than six (6)
months, or both. (W. Va. Code § 61-7-14)

Any person who engages in threatening or assaultive behavior may
be subject to arrest and criminal prosecution. (W. Va. Code §
61-6-1b and 61-6-19)
................5.2.e.C.
Any employee who violates the provisions of the Workplace Security
Policy is subject to disciplinary action, up to and including dismissal.
